How to Calculate your Settlement

If you file a lawsuit in State court you are the Plaintiff and the person being sued is the Defendant. The lawyer representing the Plaintiff is called a Plaintiff’s Attorney and has the duty of prosecuting the person or business entity which has committed the civil wrong. A Tort is a civil wrong. A Plaintiff’s Attorney has a job similar to a criminal prosecutor who prosecutes persons and business entities that commit a criminal wrong. A Plaintiff’s Attorney attempts to right wrongs. The Defense Attorney in a civil case is like a Defense Attorney in a criminal case; they attempt to prove that their client did not commit a crime or a civil wrong.

To calculate a fair settlement or judgment, enter a dollar amount for each of the above categories, where applicable, and add for a total. If the insurance company does not offer you this amount of money you should consult with a Plaintiff’s Attorney to help you recover legal damages caused by the civil wrong of the person who caused your damages.

From my experience, insurance companies will attempt to minimize damages by refusing to recognize some or all of the above legal damages. You can always agree to accept less than a fair settlement just like you can always pay too much for a car. There is an old saying: "Never buy a pig in a poke". A "poke" is a heavy sack. It is not wise to buy anything that you know nothing about and it is not wise to evaluate a personal injury settlement without knowing the law or a lawyer.
